“What is minimum wage?” has not had a single answer in decades. The federal floor has sat at $7.25 since 2009, and the states have spent those years going their own ways — Washington’s floor is now more than double the federal rate, while twenty states never moved at all.

The rule that resolves every conflict is simple, and it always favors the worker — the highest applicable floor wins. State beats federal when the state is higher; a city ordinance beats both.

What the floor does not include

Minimum wage governs the base hourly rate. On top of it sit overtime rules — time-and-a-half past 40 hours federally, with daily thresholds in a few states — plus tipped-wage rules, youth training wages and small-employer carve-outs that vary by state.

What is the federal minimum wage?
$7.25 per hour, unchanged since July 2009 — the longest stretch without an increase since the minimum wage was created in 1938. Because it has been flat while prices rose, most states have set their own higher floors, and the federal rate now governs in only about twenty states.
Which minimum wage applies to me, state or federal?
Whichever is higher. States can exceed the federal floor but cannot undercut it for covered workers, so Georgia's $5.15 state rate is a historical artifact — covered employees there earn $7.25. Cities can stack higher still, and where they do, the city rate wins.
Do tipped workers have a different minimum?
Often, yes. Federal law allows a $2.13 cash wage when tips bring the total to at least $7.25, but states vary enormously — several require the full minimum before tips. If tips ever leave you short of the regular floor for the pay period, your employer owes the difference.
